To the maximum extent permitted by applicable law, Winum, its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your use of, or inability to use, the Platform or any of the services provided. This includes, without limitation, damages for loss of profits, loss of data, business interruption, or any other commercial or financial losses, even if we have been advised of the possibility of such damages. You acknowledge that gambling involves risk, including the risk of losing money, and that you are solely responsible for any loss arising from your participation in games, regardless of whether such participation involves fiat funds, cryptocurrency deposits such as ETH deposit methods, or any combination thereof. Winum does not guarantee the uninterrupted availability, error-free operation, or complete security of the Platform, and we shall not be responsible for any interruptions, delays, technical malfunctions, or failures caused by factors beyond our reasonable control, such as internet connectivity issues, hardware or software problems, or third-party service disruptions.
Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law, including, where relevant, liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. To the extent our liability cannot be excluded but can be limited, our total aggregate liability to you for any and all claims arising out of or related to your use of the Platform or these Terms shall not exceed the total amount of deposits you have made into your Player account in the three (3) months immediately preceding the event giving rise to the claim. You agree to indemnify, defend, and hold harmless Winum and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your breach of these Terms, your violation of any law or third-party rights, or your misuse of the Platform. You acknowledge that your sole remedy in the event of dissatisfaction with the Platform or any of its services is to stop using the Platform and, where applicable, close your account. This limitation of liability is a fundamental element of the basis of the bargain between you and Winum.
Complaints & Dispute Resolution
Winum aims to provide a fair and transparent environment for all Players and to address any concerns or disputes in a prompt and professional manner. If you have a complaint regarding the Platform, including any aspect of game outcomes, account management, transactions, or the application of these Terms, you should first contact our customer support team using the designated channels, such as live chat or email. When submitting a complaint, you should provide as much detail as possible, including your account information, relevant dates and times, transaction or game references, and a clear description of the issue. We will acknowledge receipt of your complaint within a reasonable time and will endeavor to investigate and respond substantively as quickly as practicable, depending on the complexity of the matter and the need to obtain further information. During the investigation, we may request additional documentation or clarification from you, and you agree to cooperate and provide accurate information.
If you are not satisfied with the outcome of our internal complaint-handling process, you may have the right, depending on your jurisdiction and our regulatory status, to escalate the dispute to an independent alternative dispute resolution (ADR) body or to pursue legal remedies through the courts or other competent authorities. Any such external dispute resolution options and relevant contact details, where available and applicable, may be provided to you upon request or specified in supplemental information on the Platform. You agree that Winum’s records, including game logs, transaction histories, and communication transcripts, shall be the primary evidence in resolving any dispute, subject to applicable law and your right to provide counter-evidence. We may, at our discretion, suspend contested funds or freeze certain account functions during the resolution of a dispute in order to prevent further complications. These complaint and dispute resolution provisions do not affect any statutory rights you may have under applicable consumer protection or gambling laws.
Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Winum is organized or licensed to provide the relevant gambling services, without giving effect to any choice of law or conflict of law provisions that would result in the application of the laws of another jurisdiction. By using the Platform, you acknowledge and agree that, subject to any mandatory provisions of local law that may apply for your benefit as a consumer, you submit to the exclusive or non-exclusive jurisdiction (as specified by applicable regulations) of the courts of such governing jurisdiction for the resolution of any legal disputes. You understand that it is your responsibility to ensure that your use of the Platform complies with the laws of your country or state of residence, and you agree that Winum shall not be liable to you if your use of the Platform is in breach of such local laws.
If any provision of these Terms is found by a court or competent authority to be invalid, illegal, or unenforceable under the governing law, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and where such modification is not possible, the provision shall be deemed deleted. Any such invalidity or unenforceability shall not affect the remaining provisions of these Terms, which shall continue in full force and effect. You also acknowledge that, in addition to these Terms, specific regulatory requirements and license conditions applicable to Winum may impose additional rules or obligations on us or on you as a Player, and in the event of any inconsistency, such legal and regulatory requirements shall prevail. Nothing in this section shall limit the ability of Winum to seek interim or injunctive relief in any competent court to protect its rights, interests, or confidential information.
Final Provisions

Winum’s failure or delay in enforcing any right or provision of these Terms shall not be deemed a waiver of such right or provision, and any single or partial exercise of any right or remedy shall not preclude any further exercise thereof or the exercise of any other right or remedy. You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent, and any attempted assignment, transfer, or delegation in violation of this restriction shall be null and void.
Winum may communicate with you via email, on-site notifications, or other electronic means using the contact information associated with your account, and such communications may include notices regarding changes to these Terms, account information, promotions, or important legal and regulatory updates. You agree that all electronic communications from us satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law. Sections of these Terms that by their nature should survive termination of your account or cessation of your use of the Platform, including but not limited to provisions regarding limitation of liability, indemnity, governing law, and dispute resolution, shall continue in full force and effect after such termination or cessation.
